David Did It! : The Day We Said No to a Client

Why Ethical Recruitment Matters | H-FTS

Last week, I faced a decision that perfectly demonstrates why Hawthorne-Finch Talent Solutions operates differently from traditional UK recruitment agencies.

A law firm contacted us about Private Client Solicitors  and from the email they reached out to us with, we had 2 suitable candidates locally from our talent network, both outstanding candidates with impressive credentials. The Managing Partner requested CVs. Straightforward, right?

Except they wanted the candidate CVs before agreeing to our recruitment terms of business or discussing their team, culture, client portfolio etc .

Here’s the typical recruitment agency process: agencies distribute CVs to anyone interested. Terms get discussed later – if at all. Candidate consent? Often an afterthought. The focus is speed, volume, and securing that placement fee quickly.

I understand this approach. It’s efficient. It’s “industry standard”. And frankly, it’s easier.

But easier doesn’t mean ethical.

When the Practice Manager asked us to send CVs first and discuss recruitment terms later, I respectfully declined. Not from difficulty, but because our entire recruitment consultancy is built on a non-negotiable principle: we never submit candidate CVs without a clear contractual framework and written consent for each specific client. How can I get a candidates consent to be submitted when you won’t tell me about the role, company or team?

What this means in practice:

  • We don’t present firms to candidates as clients unless terms of business are agreed. If you are not a client I won’t pretend you’re a client just because you have said you want CV’s. I need to know the interview process and about you more to be able to discuss with the candidate.
  • We don’t submit CVs without formal recruitment agreements in place
  • We don’t share candidate details without explicit, written consent for each opportunity
  • We ensure all parties; candidates, clients, and consultants—are protected from the outset

The firm’s response was understandable: “We can discuss terms if there is a suitable candidate.”

Here’s the issue: To discuss this law firm with our solicitor candidates as a prospective employer, we needed that formal agreement first. Without it, we’d be misrepresenting the situation. We’d be claiming a client opportunity when, technically, we didn’t have one.

That’s not transparency in recruitment. That’s not ethical practice. And that’s not how professional recruitment agencies should operate.
